Sagala Terms of Service & EULA

These Terms of Service ("Terms") are a binding agreement between you and Sagala ("Sagala", "we", "us") governing your use of the Sagala mobile application (the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

This document also serves as the End User License Agreement required by Apple. To the extent of any conflict with Apple's standard EULA, the more protective terms for the user apply.

1. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your country) to use the App. By using the App you represent that you meet this requirement.

2. Your account

You are responsible for activity under your account and for keeping your sign-in secure. You may delete your account at any time in Settings → Delete Account, which permanently removes your server-side data as described in the Privacy Policy.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. You may not copy, reverse-engineer, resell, or build a competing service from the App except as permitted by law.

4. User-generated content (UGC)

The App lets you create spots, albums, photos, names, and notes ("Your Content"), and to make them Private (device-only), Friends, or Public.

• You own Your Content. By making content Friends or Public, you grant us and the users you share it with a limited license to store, display, and transmit that content solely to operate the sharing features you chose. Private device-only content is not uploaded and is not licensed to us.
• You are responsible for Your Content and for having the rights to any photos you upload.

5. Acceptable use — zero tolerance for objectionable content

You agree not to upload, share, or publish content that is, or that depicts or facilitates:

• harassment, bullying, hate speech, or threats;
• sexual content involving minors, or any illegal content;
• trespassing instructions, or content that encourages dangerous, illegal, or harmful activity;
• spam, scams, malware, or infringement of others' intellectual property or privacy;
• another person's private location or personal information without consent.

We do not tolerate objectionable content or abusive users. This is a condition of using the App.

6. Moderation, reporting, and blocking

• Public spots are subject to moderation review before they become broadly visible.
• You can report any spot or user, and block any user, from within the App.
• We act on reports of objectionable content and may remove content and suspend or terminate accounts within 24 hours of a valid report, at our discretion.
• We may remove content or accounts that violate these Terms with or without notice.

7. Location and safety

Spot locations are user-submitted and may be inaccurate, on private property, or unsafe. You use location information at your own risk. Always obey local laws, posted signage, and property rights. Sagala is not responsible for your conduct at any location.

8. Privacy

Our handling of your data is described in the Privacy Policy, which is incorporated into these Terms.

9. Third-party services

The App uses third-party services (Supabase, Cloudflare, Mapbox, OpenStreetMap, Google). Your use of features that rely on them is also subject to their terms. We are not responsible for third-party services.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAGALA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF THE APP OR FROM USER-GENERATED CONTENT OR LOCATIONS.

12. Termination

We may suspend or terminate your access for violations of these Terms. You may stop using the App and delete your account at any time.

13. Apple-specific terms

These Terms are between you and Sagala, not Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Apple has no obligation to provide support or to address any claims relating to the App.

14. Changes

We may update these Terms; continued use after changes means you accept them. We will revise the "Last updated" date.
